1. Agreement and eligibility
These Terms of Service form a binding agreement between you and CybrCoast LLC, a Delaware limited liability company ("CybrCoast," "we," "us," or "our"), concerning TickerBuff and related websites, applications, data displays, alerts, and services (the "Service"). By accessing the Service, you agree to these terms and our Privacy Policy.
You must be at least 18 years old and legally able to enter a contract. If you use the Service for an organization, you represent that you have authority to bind that organization.
2. Research tool, not investment advice
TickerBuff is an informational and educational research tool. It is not a broker-dealer, investment adviser, exchange, fiduciary, or trading venue. Nothing in the Service is personalized investment, legal, tax, or accounting advice, a recommendation, or an offer to buy or sell a security or derivative.
Market activity, model outputs, rankings, alerts, scenarios, chart levels, and AI-generated explanations may be delayed, incomplete, inaccurate, or unsuitable for your circumstances. A possible outcome is not a forecast or guarantee. You are solely responsible for validating information and for every investment decision you make.
3. Accounts and access
You are responsible for the email account used to access TickerBuff, all activity under your account, and keeping sign-in links and devices secure. You must provide accurate information and promptly notify us at legal@tickerbuff.com of suspected unauthorized access.
Features, limits, data freshness, and entitlements vary by plan. We may change or discontinue features when necessary to improve the Service, comply with law or licensing obligations, or protect reliability and security.
4. Subscriptions and billing
Paid plans renew automatically at the cadence shown at checkout until canceled. Fees, trial terms, taxes, and renewal dates are disclosed before purchase. You may cancel through the account or billing portal; cancellation takes effect at the end of the current billing period unless stated otherwise. Except where required by law or expressly stated at checkout, fees already paid are non-refundable.
Payment credentials are handled by our payment processor. We may suspend paid access after a failed payment and correct pricing or plan errors.
5. Acceptable use
You may use the Service for your own lawful research. You may not:
- scrape, crawl, bulk download, redistribute, sublicense, sell, or create a competing data feed from the Service;
- circumvent entitlements, rate limits, security controls, data delays, or access restrictions;
- reverse engineer the Service except to the limited extent that applicable law cannot prohibit it;
- use automated access outside documented interfaces or interfere with another user or our infrastructure;
- use the Service for market manipulation, fraud, unlawful trading, or violation of exchange or data-provider rules; or
- submit malicious code, infringing content, or personal data you lack authority to process.
6. Ownership and data rights
CybrCoast owns TickerBuff's software, interface, branding, original written material, ranking logic, and proprietary derived analytics, subject to rights in underlying inputs. Market prices, filings, news, exchange records, and other source data may be owned by or licensed from third parties. Your access does not transfer ownership of source data or permit redistribution.
You retain rights in prompts, saved layouts, and other content you submit. You grant us a limited license to host, process, reproduce, and analyze that content only as needed to operate, secure, support, and improve the Service.
7. AI and automated analysis
Automated analysis can misinterpret data, omit evidence, or generate incorrect statements. TickerBuff may constrain model tools and record technical traces to improve reliability, but human review is still required. Do not rely on AI output as the sole basis for a trade or submit confidential information that you are not authorized to share.
8. Third-party services and availability
The Service depends on market-data licensors, exchanges, cloud infrastructure, payment, email, authentication, and AI providers. Their delays, corrections, outages, or contractual restrictions can affect TickerBuff. We do not guarantee uninterrupted operation, continuous real-time coverage, or that every symbol or dataset will remain available.
9. Suspension and termination
You may stop using the Service at any time. We may restrict or terminate access for material breach, unlawful or abusive use, nonpayment, security risk, or a legal or licensing requirement. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute terms, will survive.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available." CybrCoast disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
To the maximum extent permitted by law, CybrCoast and its suppliers will not be liable for lost profits, lost trading opportunities, market losses, loss of data, or indirect, incidental, special, consequential, exemplary, or punitive damages. Our aggregate liability arising from the Service will not exceed the greater of $100 or the amount you paid us during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
11. Indemnification
To the extent permitted by law, you will defend and indemnify CybrCoast and its personnel from third-party claims arising from your unlawful use of the Service, violation of these terms, or infringement of another person's rights.
12. Governing law and changes
Delaware law governs these terms, without regard to conflict-of-law rules. State and federal courts located in Delaware will have exclusive jurisdiction, except where consumer law requires otherwise. If a provision is unenforceable, the remaining provisions remain effective.
We may update these terms. We will post the revised effective date and provide additional notice when required. Continued use after an update takes effect constitutes acceptance. Questions may be sent to legal@tickerbuff.com.
